These Terms of Service ("Terms") govern your purchase and use of BuildFlow Enterprise Pro ("BuildFlow", "the Product"), a digital spreadsheet-based construction project management tool provided by Envelop Design Limited (RC 1460230) ("we", "us", "our"). By purchasing or using the Product, you agree to these Terms.
1. The Product
BuildFlow Enterprise Pro is a downloadable digital product delivered as a Microsoft Excel file. It is provided "as is" for use in managing construction projects. We may release updates or new versions from time to time at our discretion.
2. Licence
On purchase, you are granted a non-exclusive, non-transferable, single-user licence to use the Product for your own business or professional purposes. This licence permits one user to install and use the Product on the devices they personally use.
3. Restrictions
You may not:
- Resell, redistribute, sublicense, share, or publicly post the Product or any copy of it;
- Claim the Product or a derivative of it as your own for sale;
- Remove or alter any branding, notices, or licence information within the Product;
- Use the Product for any unlawful purpose.
4. Intellectual Property
All intellectual property rights in the Product, including its design, structure, formulas, and branding, remain the property of Envelop Design Limited. Your licence does not transfer ownership of any intellectual property to you.
5. Payments
Purchases are processed by our authorised reseller and Merchant of Record. The Merchant of Record handles the transaction, issues your receipt, and is responsible for the collection and remittance of applicable taxes. Prices are shown at checkout and may change for future purchases.
6. Disclaimer of Warranties
The Product is provided "as is" and "as available" without warranties of any kind, whether express or implied. While built with care by a practising construction professional, the Product is a tool to assist your work; you remain responsible for verifying all figures, calculations, and decisions made using it. We do not warrant that the Product will be error-free or meet every specific requirement.
7. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages, or for any loss of profits, data, or business, arising from your use of or inability to use the Product. Our total liability for any claim shall not exceed the amount you paid for the Product.
8. Refunds
Refunds are handled in accordance with our Refund Policy.
9. Changes to These Terms
We may update these Terms from time to time. The current version will always be available on this page, with the "last updated" date revised accordingly.
10. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria, and any disputes shall be subject to the jurisdiction of the courts of Lagos State, Nigeria.
